PIL by Namma Bengaluru Foundation and Citizen Action Forum seeking reclamation of ecologically sensitive Agara/Bellandur wetlands admitted in High Court



High Court issues notices on Monday to State government, including Karnataka Industrial Areas Development Board, Bruhat Bangalore Mahanagara Palike and Bangalore Development Authority along with Karnataka State Pollution Control Board, Mantri Developers and Core Mind Software & Services Pvt. Ltd.

Namma Bengaluru Foundation and Citizen Action Forum along with many resident welfare associations in and around Agara Lake in south Bengaluru had filed a Public Interest Litigation (Writ Petition 36574/ 2013) on the Special Economic Zone (SEZ) project by Mantri Developers, coming up on Bellandur wetlands. The petitioners filed the PIL against the state government, related agencies and private developers. The PIL raises questions about the impact of the SEZ on environmental balance and infrastructural facilities in the area. It also questions the allotment of land meant for agriculture purpose to industrial purpose at very low price, which later turns partly residential and commercial.

The High Court of Karnataka on Monday, October 21, 2013, accepted the Public Interest Litigation against the Mantri developers and Coremind Software and Services along with other nine government departments. A bench comprising Justice K L Manjunath and Justice H S Kempanna directed that the defendants be served notices. The petitioner contended that government had allowed construction activities by two private companies which had rapidly encroached upon Rajakaluve running through the land blocking flow of water into Bellandur Lake. The petitioner also contended that real estate developers Mantri Techzone Pvt Ltd and Core Mind Software & Services Pvt. Ltd (both respondents), had proposed a Rs 2,300 crore project for setting up SEZ park, hospitality and residential sector and mall covering approximately 80 acre immediately abutting Agara lake. The petitioner further contended that the said project lies between Agara and Bellandur Lake and is located on the valley land that connects the two lakes and if construction and encroachment is not stayed, it would result in irreparable damage to environment.

The petition prays to the High Court of Karnataka that the projects be stayed and the parties (developers) be restrained from creating any third party rights or encumbrances on the said property. It prays that the court order reclamation of the land allotted to both the projects coming up on the ecologically sensitive Bellandur wetland, and restrain government and KIADB from allotting this land for purposes that may harm the environment. It also prays that orders be passed to restrain the government from alienating public land without following due process of law.
